The Freedom of Information Act (FOIA), 5 U.S.C. 552, as amended, established that records in the possession of Federal agencies are accessible to the public unless they meet one or more of the nine exemptions under FOIA or the Privacy Act of 1974 (as amended), and other authorities.

Notice pursuant to 43 CFR § 2.27

The Department is soliciting views from submitters on whether certain records are confidential information under the FOIA, 5 USC § 552(b)(4). These records are related to:

  1. amounts of refunds paid to companies with Deepwater Royalty Relief Act leases and
  2. a list of companies that agreed independently to accept price thresholds on eligible DWRRA lease
This relates to a November 3, 2015 FOIA request from Friends of the Earth

Companies with DWRRA leases can contact Office of the Secretary to review records subject to possible release.
OS will presume that you do not object to their disclosure if no response by 3/4/16. OS will release without redaction these records for companies that do not respond.
